The Legal Process to Adopt
Legally a child can have only one mother and one father at any given time. If a stepfather wants to adopt a child whose natural father is still living, then the natural father's parental rights must be terminated. This can be done either voluntarily or involuntarily.
If it is necessary to involuntarily terminate the natural father's parental rights, then the stepfather and natural mother would have to show that the natural father had abandoned or neglected the child. Obviously, the same would be true if you were to terminate the natural mother's parental rights.
The court will hold an adoption hearing at which time the adoptive parent and natural parent consenting to the adoption would submit testimony and evidence to prove that she or he is a suitable parent and able to care for and provide for the child.
